1. Review all of your finances and see if you really do need to file for
bankruptcy.
2. Before filing, get credit counseling from an organization approved by the
court.
3. Do not put more debt on your credit cards. This will not be viewed well by
the court and it could be construed as fraud.
4. Gather together all of your financial records, including documents related
to your income, mortgages and other loans, medical bills, credit cards
statements, savings and checking accounts, stocks, etc.
5.Consult the National Association of Bankruptcy Attorneys and the American
Bankruptcy Institute websites.
Do You Need an Attorney?
The law does not require that you retain a bankruptcy lawyer, but there are many
benefits to doing so. These include:
- Help with determining whether you file for Chapter 7 or Chapter 13.
- Knowledge of the entire process.
- Proper documentation of your case.
- Proper filing of all paperwork.
- Representation in court.
- Representing you to creditors.
