When a client comes to my Sacramento area office to enlist my services as a

are considering Chapter 7, which allows them to pay off certain debts and have
others forgiven. But the fact is that some won’t be allowed to file for Chapter 7.
Means Test
The fact is that although a seasoned bankruptcy lawyer can advise you as to the
likelihood of you’re being able to file for Chapter 7, you’ll have to make a full
disclosure of your financial situation. Once the court trustee assigned to your case
reviews all of your paperwork and figures, they will decide if you pass the means
test. If it’s determined that you do not pass the means test then you’ll probably need
to file for Chapter 13 instead.
Chapter 13
As I tell my clients in the Sacramento area, Chapter 13 will still stop creditors from
harassing you. Also with Chapter 13, you’ll pay a certain amount of your income to
the court and the trustee will pay your creditors who have agreed to the payment
arrangements. You will be able to keep your home and vehicle. Some debt will be
forgiven.
