A Sure Thing: Moving Forward with Chapter 7 or Chapter 13 Bankruptcy when Plan A is Not Going to Happen
[Chapter 7 and Chapter 13 Bankruptcy Lawyer discusses using Your Bankruptcy Options as Plan B]
Did you ever go after “a sure thing” and find it was not what you expected? The sure-thing had an iron-clad guarantee; it fulfilled all the criteria for perfect success; it promised to pay off according to plan –and it simply did not.
And unless there’s been obvious fraud or other legal malfeasance, we’re not going to turn around and sue the wrongdoer to get our money’s worth . No, we’re going to take it on the chin and keep looking for another sure-thing. Isn’t this pretty much the way things normally go?
As a bankruptcy attorney, my service is all about assisting in “Plan B” for people who had a “Plan A” that did not fly. All my clients had detailed plans (Plan A) for very reasonable, logical achievement.
They were not taking inordinate risks – at some point, Plan A was ahead, possible, exciting — it really did seem like a sure-thing.
Some started a business and the money, timing, people didn’t come through as expected – Now Plan B is Chapter 11;
Some worked for years at what they thought was a career, but lost what turned out to be a job; some invested in real estate and other traditionally “safe” places, but little by little got into debt beyond their ability to pay. Maybe Plan B will become Chapter 7;
Some had excellent health, but that changed suddenly and they incurred medical bills, some had a storm hit their house, uninsured for that peril, so their bank account took a hit too – Now Chapter 13 will be Plan B to reorganize their finances.
Everything they had thought would go according to plan, has gone in an unexpected direction. Was there something wrong with their Plan A? No, certainly not – but there were unpredicted events that forced a change of plans. Plan B actually is a backup plan for success in dealing with the unexpected.
